President Trump’s total and absolute return-to-office mandate for federal employees has unleashed an extra trauma on the civil service that belies the administration’s stated goal of making our government more efficient. In-office work has substantial benefits, including opportunities for face-to-face collaboration and mentorship, which help to foster organizational culture and cohesiveness. And there may indeed be value to increasing in-office work in a thoughtful fashion. About half of the federal workforce has never operated remotely, even during the height of the COVID-19 pandemic. However, the other half has been eligible to telework over the past decade, and remote work levels in the federal government are essentially on par with what you see in the private sector for those who have the ability to operate outside the office. These are inconvenient facts for the president and his Department of Government Efficiency, which appears to view the order as a way to incite mass resignations from the federal workforce and assumes that employees who telework are uniformly unproductive. https://lnkd.in/eWNhSnQ7 In truth, this mandate has done everything but spark productivity. The administration’s decision to order all federal employees to work from physical offices without adequate preparation or understanding of impact has been enormously disruptive. Since returning to the office, federal workers have: • Faced shortages of desks, chairs, computer monitors, Wi-Fi and basic supplies like toilet paper and soap. https://lnkd.in/eEpyndXN • Had to work in closets, conference rooms and cafeterias. https://lnkd.in/exPNJaCJ • Been told to report to offices halfway across the country, or to facilities that are not government workspaces, including self-storage buildings and a closed sandwich shop. https://lnkd.in/eW8_EYFq • Had to do janitorial work, make seating charts and track down equipment. https://lnkd.in/emprB45Z • Taken calls about sensitive and proprietary projects in crowded, shared spaces. https://lnkd.in/emprB45Z These stories and many more do not square with effective government, and they would not be tolerated in the best of the private sector, which the administration claims to emulate. Once again, we are seeing costly waste that hurts the American people and those that serve us all. The Justice Department’s recent decision to put a career prosecutor on administrative leave because he did not “zealously advocate” on behalf of the Trump administration during a court hearing is an alarming attempt to weaponize the law for political purpose. https://lnkd.in/eVCF875Q A bedrock of legal ethics is that government lawyers and prosecutors must first and foremost be truthful to the court—even if the truth comes at the expense of winning a case. This principle was most notably captured in an often-cited 1935 Supreme Court decision by Justice George Sutherland, who wrote of prosecutors, “It is as much [their] duty to refrain from improper methods calculated to produce a wrongful conviction as it is to use every legitimate means to bring about a just one.” https://lnkd.in/ePyHFqxn The current case, now well-documented, involves Kilmar Abrego Garcia, a man the administration admitted was deported to El Salvador due to an “administrative error.” During a court hearing on whether to return Garcia to the U.S., the government’s lawyer, Erez Reuveni, told a judge he lacked a “satisfactory” answer about why Garcia was still detained. Reuveni also acknowledged that Garcia “should not have been removed” from the U.S. and noted the “absence of evidence” justifying his arrest. Suspending Reuveni for making true statements fundamental to the pursuit of justice is wrong and dangerous, regardless of how the particulars of this case play out. Career prosecutors play an essential role in our democracy by upholding the law. By punishing Reuveni for acting on these principles, the Justice Department leadership is subverting the law to a partisan agenda, putting a thumb on the scale of justice and sending a clear message to other government lawyers: Put politics above principle. Our democracy, the rule of law and the welfare of the American people are on the line, and we should all be worried.

There is no other powerful way to serve the public than to be a public servant—one who takes an oath to represent the United States of America. What is happening to the federal workforce right now is not efficiency. It is arson to a public asset that has profound consequences. There is no rationality here. Public servants are being treated in the worst possible way for no good reason.
