The Home Office has announced plans to tighten Right to Work rules by placing legal responsibility on businesses to check the status of all individuals working on their behalf, even if they are not directly employed. This proposed change would include those engaged via gig platforms, zero-hours contracts, or subcontracting arrangements but it will apply more broadly to anyone working in the name of the business, regardless of the contractual setup. It marks a significant shift from the current position, where the obligation to check typically only applies to direct employees. If implemented, businesses will need to carry out and evidence Right to Work checks across a much wider range of working relationships or risk substantial fines, enforcement action and reputational damage. An Executor of a Will is entitled to see a copy of the Will file. However, if you are not named as an Executor you can still request information relating to the Will by way of a Larke v Nugus request to the Will Writer. A Larke v Nugus request is a letter from someone interested in the Estate of a deceased person i.e. a named beneficiary who is not Executor or a claimant against the Estate, and it seeks information from the Will Writer as to the production of the Will and execution of the Will.
