However, disputes often occur when employers demand longer hours without appropriate compensation. The ambiguity in defining overtime can lead to disagreements over remuneration, with employees feeling exploited when required to work beyond standard hours without receiving legally mandated extra pay. The European Banking Authority (EBA) issued an answer on whether overtime pay awarded to staff members should be included in their total gross annual remuneration for the purposes of calculating the gender pay gap. 🔍 Key Takeaways: ▶️ Payments for overtime should not be taken into account for the gender pay gap calculation. ▶️ The answer stems from the principle that overtime pay is for additional hours worked beyond the agreed contract, thus, it does not contribute to the standard measure of pay inequality between genders. 🤷♂️ The So What? ✅ Employers must update their policies on pay remuneraton to comply with EU capital requirements directive. ✅ Under Pay Transparency Directive gender pay gap reporting will be mandatory for employers with: 1) 250+ employees (they report annually from 7 June 2027). 2) 150-249 employees (they report every three years from 7 June 2027). 3) 100-149 employees (they report every three years from 7 June 2031). 📩 Do you have any questions? 🌍 Recently, I attended a class on employee agreements around the globe, led by Deepak Arora Course Anchor at Skill Arbitrage. I learned about various agreements, including the standard employment agreement, consulting agreement, and zero-hour contract agreement. The zero-hour contract, common in the UK, particularly caught my eye. Neither the employer nor the contractor is obligated to provide or accept work—they work at their own will. 💡 In California, I discovered some fascinating facts: - Minimum wage is $16/hour. - Overtime pay is 1.5x for 8-12 hours and 2x after 12 hours. However, employers need strategic measures to prevent abuse of overtime payments, such as defining workloads per standards. Without OT pay, there's a risk of overloading workers. Also, interestingly, both non-compete and non-disclosure clauses are void in California. These insights have expanded my knowledge, and I look forward to diving deeper and sharing more exciting takeaways. Expecting to visit some excellent clients and partners in Japan 🇯🇵 next week. WELDON parcel boxes have been great helpful to tackle the "2024 problem," a term used in Japan to describe anticipated truck driver shortages when new overtime regulations go into effect 2024. The Japan government will launch a program to give points to shoppers who choose to have delivery parcels left outside their front doors in order to reduce the workload of delivery drivers. In June 2023 the government set a goal of halving the re-delivery rate, which then stood at 12% or so, to 6% by fiscal 2024.
