DID YOU KNOW? The Nigeria Data Protection Commission (NDPC) has extended the registration deadline for Data Controllers and Data Processors of Major Importance (DCPMIs) to 31st October 2024. This extension grants DCPMIs additional time to fulfil their registration obligations and mitigate the risk of non-compliance penalties under the Nigeria Data Protection Act (NDPA) 2023. It should be noted that on 14th February 2024, the NDPC issued a Guidance Notice mandating DCPMIs to register by 30th June 2024. This deadline was later extended to 30th September 2024. The latest extension now provides DCPMIs a final opportunity to register without incurring penalties until the new deadline. Non-compliance beyond 31st October 2024 will constitute a violation of the NDPA, subjecting defaulting DCPMIs to enforcement actions. DCPMIs are therefore urged to take prompt action to avoid potential legal consequences as prescribed under the NDPA and the Nigerian Data Protection Regulation 2019 (NDPR). Lack of a Certified Data Protection Officer: The NDPC requires a certified Data Protection Officer (DPO) to validate your registration. A certified DPO is one with recognised training in data protection. Heads-up: You will need to upload a certification for verification. 2. Incorrect Classification Level: The NDPC categorizes data processing into three levels: Ultra-High, Extra-High, and Ordinary High. Registering under the wrong classification may lead to a query.
