📲 What do the April 11th changes to the #TCPA mean for #healthcare communication? Robert Farrell, CEO of mPulse, breaks it down in our latest #HITshow interview. “The Telephone Consumer Protection Act is a great regulation. It helps protect people from unwanted solicitations. But as it relates to healthcare… it's really important to be able to have that two-way communication — in most cases by text, but if not, by email, by IVR.” Healthcare organizations depend on timely, compliant communication to guide patients through appointments, results, payments, and more. But tightening regulations around consent and communication methods could impact how that outreach happens. “My 93-year-old dad is in a nursing home and I get texts from them every day about what’s going on with his care. Yes, it’s peace of mind, but it’s also very practical — there are actions I need to take to make sure his care is done the right way.” Robert warns that being too cautious in response to TCPA could harm patients more than help. “You don’t want a hospital GC saying, ‘No texting to anybody.’ That’s just not good for the health consumer.” The path forward? Earlier this week, mPulse petitioned the Federal Communications Commission to delay the effective date of new #TCPA Consent Revocation rules. The rule is not widely publicized but has a major impact on #healthcare communication and engagement strategies. Essentially, if a consumer opts out of an automated message or IVR call, that opt-out must apply to all automated messages or IVR communications from that organization unless, through a ‘clarification step’, the consumer specifies types of messages/calls that they still want to receive and to which they previously provided consent on a topic basis. Healthcare organizations are working diligently to implement the requirements of the new rule, and mPulse is supporting these updates. However, there is a risk that organizations don’t have optimal systems and processes in place when the rule comes into effect on April 11th, 2025. This will result in #healthconsumers unwittingly opting out of important health communications and/or healthcare organizations dialing back communications to reduce opt-out rates, so that patients and health plan members miss getting the care, medicines and health support that they need. Additionally, any content updates associated with the rule for #Medicaid plans will require review by state Medicaid agencies, adding to the scale of updates. mPulse supports the importance of providing consumer centric experiences and providing consumers with tools to manage their healthcare experience. We strongly feel a delay in the rule will benefit both the health consumer and the organizations managing their health.
