LICA members should be aware of the current proposed changes to the NYS WC system regarding medical providers. This is a significant shift and not one which is has been well received by business.
NEW YORK: At the recent State of the State, NYS Governor Kathy Hochul outlined several proposed changes to the New York State Workers' Compensation Board. One of the more significant, and potentially concerning proposals is the elimination of the Board’s authorization process for medical providers. This change would allow any medical provider, including Physician Assistant,s and Nurse Practitioners to treat injured workers in New York State without Board oversight. Given that the system already contends with widespread fraud, including schemes involving currently authorized providers, removing this oversight would strip the state of its ability to restrict problematic practitioners and significantly increase the risk of insurance fraud. Furthermore, shifting payment responsibility to commercial health carriers exacerbates the issue. It would require these carriers to cover costs on controverted claims during investigations, forcing them to pay for treatment on claims that may later be deemed invalid. This places an undue financial burden on carriers, who under current policies, should not be liable for such payments. This proposal warrants careful consideration and robust discussion before implementation, as the potential unintended consequences could be far-reaching.
