Welcome back to our ABCs of Community Development Law series. Today, N is for New Markets Tax Credits (NMTC), a federal program that helps bring investment into communities that have been historically underserved. The NMTC program provides federal tax credits to private investors who invest in development projects located in qualifying low-income census tracts. These investments support a wide range of community needs, including commercial real estate, health centers, charter schools, food hubs, and mixed-use developments. The goal is to attract private capital into neighborhoods where traditional financing is often limited or unavailable. From a legal perspective, NMTC deals are complex and require coordination between investors, community development entities (CDEs), and project sponsors. Attorneys structure transactions, manage compliance with program rules, and help ensure the financing delivers real benefits to the community. New Markets Tax Credits are a key part of the legal and financial toolkit for equitable development.
