The CPPA was created in 2020 following the approval of Proposition 24 by California voters. The CPPA is responsible for the implementation and administrative enforcement of the nation’s first comprehensive consumer privacy law, the California Consumer Privacy Act, including as amended by Proposition 24, the California Privacy Rights Act; for promoting public awareness and understanding of the risks, responsibilities, and rights in relation to the collection, use, and disclosure of Californians’ personal information, and for providing guidance to consumers and businesses on complex matters relating to online privacy, cybersecurity, and automated decision-making, among other duties.

Eight state regulators have announced their collaboration to implement and enforce privacy laws to protect consumers. The bipartisan group — known as the Consortium of Privacy Regulators — includes the California Privacy Protection Agency and the Attorneys General from California, Colorado, Connecticut, Delaware, Indiana, New Jersey, and Oregon. The states’ laws share certain fundamental features that allow the consortium to work together on promoting the privacy rights of consumers. The CPPA and the New Jersey Attorney General (NJ AG) submitted a joint letter to the House Committee on Energy & Commerce’s Privacy Working Group. The letter is in response to the Working Group’s request for public comment as they explore a comprehensive federal data privacy and security law. The letter highlights the vital role states play in privacy protections. States have led the charge in crafting privacy laws that protect consumers. The CPPA and the NJ AG support a federal law that sets a strong baseline while empowering states to go further. Good news! AB 566 is one step closer to becoming law. The bill has advanced out of the Assembly Privacy Committee and now heads to the Assembly Appropriations for consideration. This crucial bill requires browsers and mobile operating systems to support opt-out preference signals (OOPS) and make it easier for Californians to exercise their privacy rights. An OOPS gives consumers the ability to opt-out of the sale and sharing of their information with websites they visit online in a single step, rather than submitting individual requests to the hundreds or thousands of businesses they interact with online. While the California Consumer Privacy Act (CCPA) already gives California consumers the right to stop the sale and sharing of their personal information through opt-out signals, most browsers do not currently offer native support for OOPS. If passed, California would become the first state in the nation to mandate support for OOPS, helping better protect consumers from the misuse of their personal data collected on the internet and making it easier than ever for Californians to exercise their privacy rights.
