One of our amazing clerking team, Eden Cobb (Civil clerk) and his friend are attempting to run an Ultra marathon on April 26th 2025, from Liechtenstein, through Austria and into Switzerland (all while gasping for breath at an incredibly high elevation). Pascale Hicks has secured the dismissal of a claim, at trial, in its entirety pursuant to section 57 of the Criminal Courts and Justice Act 2015 with a finding of fundamental dishonesty and an order for the Claimant to pay the Defendant's costs on an indemnity basis. The Claimant, in a breach of duty admitted accident, alleged that he suffered multiple personal injuries and claimed several heads of special damage. At trial, the Claimant gave evidence, via an interpreter, but the cross examination revealed the Claimant's credibility was wholly undermined and the explanations were not credible. The Judge held that Claimant was fundamentally dishonest and his dishonesty had gone to the root of the claim and therefore by operation of section 57 of CJCA Act the entire claim would be dismissed.
