Great work Charles Brewin and Laura Smith! Following on from the success of last year's NextGen Network seminar series in Guernsey, Collas Crill's NextGen team is hosting a series of industry working breakfasts throughout 2025. The first event was Charles and Laura's presentation on the topic of demystifying offshore trusts - and it was a full house! What actually *is* an offshore trust? To launch Collas Crill’s NextGen series for 2025, Laura Smith and I were tasked with demystifying offshore trusts for our peers. We discussed why people use them and the roles of each stakeholder, before considering examples of real-life trust disputes and identifying emerging trends in offshore private wealth. Our key takeaways? 1️⃣ Whatever your role, always consider *why* you are doing whatever it is you do in the context of each particular structure. 2️⃣ As well as knowing what your role is, you should know what your role *isn’t* – and when to rely upon your network of trusted advisors. 3️⃣ Don’t be afraid to speak up. Never assume that someone with more experience or expertise hasn’t missed something. And finally, when in doubt, speak to a lawyer! #offshoretrusts #privateclient #nextgen

In the second guide of our new trust briefing series we focus on the principles of disclosure, judicial oversight and enforcement of Jersey trusts, as well as some practical considerations for settlors. Under Jersey law, a trust is a fiduciary relationship in which the trustee holds property for the benefit of beneficiaries (or objects in the case of a charitable or purpose trust). A key element of being a trustee under Jersey law is accountability for the stewardship of the trust's assets. That principle of accountability is buttressed by the ability of beneficiaries to seek, and be provided with, relevant information and documents regarding the trust’s administration. We are delighted to announce the promotion of Andrew Peedom to Partner. Andrew is a member of our private client and trusts team in Cayman. He has extensive experience in complex commercial litigation, with a focus on contentious and non-contentious trust and estate disputes, many of which have a multi-jurisdictional element. Andrew was admitted as a solicitor of the Supreme Court of New South Wales in 2001, the High Court of Australia in 2003 and as an attorney of the Cayman Islands in 2017. He has worked offshore since 2010, first in Guernsey, where he was heavily involved in one of the largest trust disputes in the Channel Islands that was ultimately determined by the Privy Council, before moving to the Cayman Islands in late 2016. Striking the appropriate balance Anti-money laundering measures raise difficult questions of mediating the collective interests of the State with the rights of individuals. In Guernsey the starting position is that every person is entitled to the peaceful enjoyment of their property. This right is not absolute but any infringement by the State must be proportionate and for a lawful reason. Anti-money laundering legislation is in place in the form of the Disclosure Law, meaning that any institution which knows or suspects, or has reasonable grounds for knowing or suspecting, that another person is engaged in money laundering or that certain property is or is derived from the proceeds of any person's criminal conduct to make a disclosure to the Guernsey Financial Intelligence Unit (FIU). However in raising a suspicion with the FIU, the institution itself is then at risk of committing a money laundering offence under the Proceeds of Crime Law if it takes any actions relating to any assets associated with the disclosure. It could end up with its assets being subject to an informal freeze.
