This provided useful guidance on a number of issues in this Construction All Risks policy dispute. Limitations on performance bond coverage for wages and benefits   We share this article by our Exclusive Member in #Colombia, Brigard Urrutia, featuring insights from our former president Lucas Fajardo Gutiérrez and his colleague Luis Alejandro Peña García on a recent ruling by the Colombian Supreme Court of Justice regarding a surety bond coverage for wages and benefits.   The Court analyzed a case in which an employer was held jointly liable for outstanding labor obligations under a collective bargaining agreement. New report! 2025 Taxation on reinsurance premiums Latin America The world’s main reinsurance markets typically provide their services on a cross-border basis for Latin American cedants, given the limited reinsurance capacity within the region compared to the demand from insurance companies. Consequently, these cross-border transactions create taxation challenges for the local governments where the cedants are domiciled, as foreign reinsurers collect premiums while being located in other jurisdictions. As a result, most Latin American tax authorities have implemented withholding tax rates on outbound reinsurance premiums paid by local cedants to foreign reinsurers. This updated 2025 report provides a comparison of the withholding tax rates applicable in the region and includes more jurisdictions such as Dominican Republic, Guatemala, Honduras, El Salvador, Nicaragua and Puerto Rico. Today we share this article by our Exclusive Member in #Colombia, Brigard Urrutia, featuring insights from our former president Lucas Fajardo Gutiérrez and his colleague Luis Alejandro Peña García on a recent ruling by the Colombian Supreme Court of Justice regarding tort liability insurance.   The Court upheld a ruling rejecting a consumer protection claim related to a 2022 highway flooding case. The affected parties argued that the highway concessionaire was liable, and that the insurer should compensate them, relying on a Comptroller General’s report. However, the Court concluded that no judicial or administrative authority had established the concessionaire’s liability, nor had any sanction been imposed. Consequently, the Court determined that the insurance coverage could not be triggered, as indemnification under a tort liability insurance requires proper proof of the insured’s liability. https://lnkd.in/djqw2DQc #insurancelaw #insuralex Carlos Sucre Levy Jose Luis Vega Meza Laura Manz David ROIG
