Today we share this article by our Exclusive Member in #Colombia, Brigard Urrutia, featuring insights from our former president Lucas Fajardo Gutiérrez and his colleague Luis Alejandro Peña García on a recent ruling by the Colombian Supreme Court of Justice regarding tort liability insurance. The Court upheld a ruling rejecting a consumer protection claim related to a 2022 highway flooding case. The affected parties argued that the highway concessionaire was liable, and that the insurer should compensate them, relying on a Comptroller General’s report. However, the Court concluded that no judicial or administrative authority had established the concessionaire’s liability, nor had any sanction been imposed.
