When can a foreign judgment be enforced in Luxembourg without “exequatur”? Xavier Guzman and Audrey Mucciante analyse the 4 April 2025 judgment from the Luxembourg District Court, which tackled this question in the context of an English restructuring judgment, advised by DLA Piper.   The plaintiffs - dissenting creditors - argued that “exequatur” was required for the effects of such foreign judgment to apply in Luxembourg. Without an international treaty or EU regulation, foreign judgments must first be subject to “exequatur” under Article 678 of the New Code of Civil Procedure (Nouveau Code de Procédure Civile). Luxembourg is moving forward with the implementation of Regulation (EU) 2024/886 on instant credit transfers in euro. On 4 April 2025, the Luxembourg Parliament adopted the bill amending the national payment services law, a key step to aligning with the new EU framework.   𝗪𝗵𝗮𝘁’𝘀 𝗰𝗵𝗮𝗻𝗴𝗶𝗻𝗴?
