And if you are operating in idiosyncratic jurisdictions like China, Indonesia and India, you would know that the restructuring processes are often prolonged, complicated and contentious. It’s in these kinds of situations since at least the 1998 Asian financial crisis that bank lenders, bond investors and other types of credit investors have found that many, if not most, bond trustees and loan fiscal agencies don’t meet their needs. And with the rise of special situations lending and private credit in Asia Pacific, investors have found they have a need for independent agents who provide them with specialised fiscal and security services as well as help them address the risks they face in such transactions. Recognition of Madison Pacific’s revolutionary role in the Asian credit market has long been coming. “Up until only a few years ago, it (Madison Pacific) was the only fiscal or security agent that differentiated the way it did things,” said Mark Chadwick, a former head of FTI Consulting’s Southeast Asia insolvency-services practice in Singapore. “Until they came around, it would take six to 12 months simply to get an agent comfortable with the indemnity capable of being provided. Madison Pacific had a much better understanding of the risks that they faced, primarily as many of the key staff had previously worked at the coalface in legal practice or debt restructurings and understood the practical risks a lot better.” Madison Pacific was founded in 2010 — two years after the 2008 financial crises — in response to the market’s crying need for trustees and fiscal agents that could be relied on to be nimble, practical and commercial in stressed/distressed debt situations. And as special situation funds moved on from participating in bank-led primary loan deals during the 2003-2008 era to originating their own loan deals in the years that followed, they increasingly needed an agent that could not only provide them with administrative services but also help them address the inherent risks of the facilities they were underwriting…”

It was a great opportunity joining the panel for the “Plenary Session: Special Situations and Distressed Debt: Identifying Opportunities” at the Insolvency Practitioners Association of Singapore (IPAS) 2024 Singapore Insolvency Conference held October 9-10, alongside Jin Low (Kroll), Billy Anugerah (SC Lowy) and the very able moderator Chin Seng Chew (Clifford Chance). As a conversation from different perspectives - an insolvency practitioner, private equity, legal counsel, and corporate trustee – the panel provided real time holistic views on trends and challenges in the distressed debt and special situations space across several jurisdictions, whilst highlighting the changing parameters when evaluating opportunities. Particularly useful was the shared transactional experience of the panel which also illustrated the different rationales applied to new investment and restructuring criteria. Thanks to IPAS in hosting a relevant and informative program and event!

A few weeks ago I had the pleasure of sitting on the INSOL International Future Leaders Panel alongside Paul Quinn, Tiffany Wong and Frederick Hui where we discussed career choices and work life balance. Some of the key themes included working out what is important to you, setting boundaries, always leaving doors open, building your network by putting yourself "out there"; but also working hard and earning your stripes. Im lucky to have a supportive workplace that allows me to do the juggle! A highlight of the evening was listening to Aisling Dwyer interview the Honourable Madam Justice Linda Chan, Court of First Instance of the High Court of Hong Kong SAR. The INSOL International Future Leaders Programme is a fantastic opportunity for budding practitioners who want to develop their career and global network.
