Yesterday, U.S. Attorney General Pamela Bondi announced that the U.S. Department of Justice will seek the death penalty against Luigi Mangione. Mangione is charged with murdering UnitedHealthcare executive Brian Thompson on December 4, 2024. The ABA Death Penalty Representation Project firmly believes in the importance of counsel for those facing a death sentence. According to a recent report from the Los Angeles Times, “District Attorney Nathan Hochman will allow prosecutors to seek the death penalty again in Los Angeles,” marking “a significant shift in one of the largest prosecutor’s offices in the nation.” California houses the country’s largest death row population but hasn’t conducted an execution since 2006. A month ago today, the U.S. Supreme Court vacated Richard Glossip’s murder conviction and death sentence and ordered a new trial. Glossip was originally convicted and sentenced to death in 1998. In the decision, written by Justice Sotomayor, the Court determined that the prosecution violated its obligations under Napue v. Illinois (1950), which held that prosecutors have a constitutional obligation to correct false testimony. WilmerHale served as pro bono counsel for Glossip and was critical in securing this victory. So far in 2025, there have been 10 executions across the county. Last week alone, there were four executions in four different states. March 18: Jessie Hoffman (LA) March 19: Aaron Gunches (AZ) March 20: Wendell Grissom (OK) March 20: Edward James (FL) Three of the four executions were completed by lethal injection. Jessie Hoffman was executed by nitrogen hypoxia--the first execution using that method in the State of Louisiana. On Tuesday, the State of Louisiana executed Jessie Hoffman in the State’s first nitrogen gas execution. It was also the State’s first execution in over a decade. Just before the execution, the U.S. Supreme Court asked Hoffman’s request for a stay of execution in a 5-4 split decision. Law firm Crowell & Moring served as pro bono counsel, recruited through the ABA Death Penalty Representation Project, for Hoffman through his final appeal. Hundreds of stakeholders, including more than 130 civil rights, faith-based, and racial justice organizations have called upon President Biden to commute the death sentences of the 40 men on federal death row. They point to serious issues in the federal death penalty system, which mirror those in the states, such as racial bias, geographic disparity, lack of adequate defense, and unreliable forensic evidence.
