Notice:

We are writing to bring to your immediate attention the non-compliance by   Bank in updating the GST number on the credit card statements of Ms. Prity Khastgir (Account No.: [Account Number Ending with 14100], Credit Card No.: [Credit Card Number]). Additionally, we highlight potential fraud committed by bank employees, including Gayatri Devgan who was employed by Axis Bank and had access to Ms. Khastgir's account, compensation for mental trauma suffered by the customer, and the misuse of customer transactions for creating blockchain codes without consent.        

### Legal Provisions Violated

1. Section 35A of the Banking Regulation Act (BRA):

- The RBI has the authority to issue directives to banking companies to ensure their proper management. The failure to update the GST number on credit card statements constitutes a violation of RBI guidelines and regulatory requirements.

2. Section 36 of the BRA:

- The RBI has the power to supersede the board of directors of banking companies if their affairs are managed in a manner detrimental to the interests of depositors or the public. The continued non-compliance with GST regulations could be seen as detrimental to the interests of customers.

3. Section 45 of the BRA:

- The RBI may apply to the central government for the compulsory amalgamation or reconstruction of a banking company. Non-compliance with GST regulations could be a factor considered under this section.

4. Section 10B of the BRA:

- The RBI has the authority to remove any person elected as the chairman or managing director of a banking company. This provision underscores the RBI's role in ensuring compliance with regulations.

5. Section 22(4) of the BRA:

- The RBI has the power to cancel the license of a banking company or cooperative bank. Non-compliance with GST regulations could lead to such actions.

6. RBI's Guidelines on GST:

- The RBI has issued guidelines requiring banks to ensure compliance with GST regulations. The failure to update the GST number on credit card statements is a violation of these guidelines.

7. Indian Penal Code (IPC) Sections:

- Section 405 (Criminal Breach of Trust): If employees misappropriate customer funds or information.

- Section 406 (Punishment for Criminal Breach of Trust): Penalties for those found guilty under Section 405.

- Section 420 (Cheating and Dishonesty): If employees deceive customers to gain financial advantages.

- Section 120B (Punishment for Criminal Conspiracy): If employees collude to commit fraud.

8. Banking Ombudsman Act, 1995:

- Provides a forum for customers to lodge complaints against banks for unfair practices or poor service.

9. Fair Debt Collection Practices Act (FDCPA):

- Bans harassment: Private banks are prohibited from harassing, oppressing, or abusing consumers in connection with debt collection. This includes threatening violence, using profane or obscene language, or repeatedly calling with the intent to annoy.

- Prohibits false or misleading representations: Banks cannot make false statements about the debt, its amount, or the consequences of not paying it. They also cannot impersonate government officials or attorneys to intimidate consumers.

- Restricts communication: Private banks must follow specific rules when communicating with consumers about debts. This includes not contacting consumers at unreasonable times or places, and not contacting them at work if they know the consumer's employer prohibits such communications.

- Requires validation of debts: Private banks must provide consumers with a written notice that includes the debt amount, creditor name, and instructions for disputing the debt.

- Restricts unfair practices: Banks cannot engage in unfair practices such as collecting fees not permitted by the agreement, depositing post-dated checks prematurely, or threatening to take action they cannot legally take.

10. Malaysia's Personal Data Protection Act 2010:

- Governs the use and protection of personal data in Malaysia. Unauthorized use of personal data for creating blockchain codes without consent may violate this act.

11. Singapore's Personal Data Protection Act 2012:

- Governs the collection, use, and disclosure of personal data. Unauthorized use of personal data for creating blockchain codes without consent may violate this act.

### Financial Data Context

As of the Financial Year 2025-2026, for the month of May, the ITC Balance of Ms. Prity Khastgir as on date 04-05-2025 is ₹50,394.00. This financial data further underscores the importance of accurate and compliant record-keeping by Axis Bank.

### Press Charges Against Malaysia and Singapore Governments

We also bring to your attention the misuse of customer data by the governments of Malaysia and Singapore. It has come to our notice that these governments have been involved in the unauthorized use of customer transactions for creating blockchain codes without consent since 2008. This action may violate the following international legal provisions and data protection laws:

1. Malaysia's Personal Data Protection Act 2010:

- Prohibits the unauthorized use of personal data without the consent of the data subject.

2. Singapore's Personal Data Protection Act 2012:

- Prohibits the unauthorized use of personal data without the consent of the data subject.

3. General Data Protection Regulation (GDPR):

- If the data is processed within the EU or involves EU citizens, the unauthorized use of personal data may constitute a violation of the GDPR.

### Reporting FDCPA Violations to the CFPB

If you believe a debt collector has violated the FDCPA, you can report the violation to the Consumer Financial Protection Bureau (CFPB) through the following steps:

1. Online Complaint Submission:

- Visit the CFPB’s official website at [www.consumerfinance.gov/complaint](https://www.consumerfinance.gov/complaint) to submit a complaint online.

- Provide detailed information about the debt collector’s actions, including the name of the debt collector, the amount of the debt, and specific details of the violation.

- Attach any relevant supporting documents, such as call logs, emails, text messages, and letters.

2. Phone Complaint Submission:

- Call the CFPB’s toll-free number at 1-855-411-2372 to report the violation.

- Be prepared to provide detailed information about the debt collector and the nature of the violation.

- The CFPB will guide you through the process and assist you in filing the complaint.

3. Mail Complaint Submission:

- Send a written complaint to the CFPB at the following address:

- Consumer Financial Protection Bureau

- P.O. Box 4503

- Iowa City, IA 52244

- Include your name, address, phone number, and a detailed description of the violation.

- Attach any relevant supporting documents.

### Demand for Action

1. Immediate correction of the GST number on all future credit card statements of Ms. Prity Khastgir.

2. Provide a written acknowledgment of this notice within 7 days of receipt.

3. Furnish a detailed report on the steps taken to rectify the issue and prevent recurrence within 14 days of receipt of this notice.

4. Compensate the customer for any inconvenience caused due to this non-compliance.

5. Reimburse the customer for all legal fees incurred in drafting and sending this notice, calculated from 2005 onwards.

6. Pay damages to the customer for emotional distress, reputational harm, and financial loss suffered due to the bank's non-compliance and potential employee fraud, dating back to 2005.

7. Compensate the customer with 1 Crore and 55 Lakhs for the mental trauma caused over the prolonged period of non-compliance and potential fraud.

8. Provide a detailed explanation and cease the unauthorized use of the customer's transaction data for creating blockchain codes or any other purpose without explicit consent.

9. Conduct a thorough investigation into the actions of Gayatri Devgan and any other employees who may have had access to Ms. Khastgir's account to determine if any misconduct occurred.

10. Press charges against the governments of Malaysia and Singapore for the misuse of customer data and creation of blockchain codes without consent since 2008, under the aforementioned legal provisions.

11. Identify and secure all associated bank accounts of the Khastgir family to prevent further misuse of their data.

### Consequences of Non-Compliance

- Legal Proceedings: If the above demands are not met within the stipulated time, we reserve the right to initiate legal proceedings against Axis Bank under the aforementioned provisions of the BRA, RBI Act, IPC, FDCPA, and any other applicable laws.

- Reporting to Regulatory Authorities: We will report the non-compliance and potential fraud to the RBI and other relevant regulatory authorities.

- Public Disclosure: We may consider making this matter public to inform other customers of Axis Bank about the bank's non-compliance with regulatory requirements and potential employee misconduct.
