Occupational health practitioner : “What is constructive dismissal ? “ ‘Constructive dismissal refers to when an employee resigns due to their employer's conduct, which makes it intolerable for the employee to continue working . This may be in the context of breaches of the employment contract , harassment , unreasonable changes to duties , false accusations,not providing a safe working environment etc . In Ireland the relevant legislation is Unfair Dismissal Act 1977-2015. Given that employees may commence sick leave due to perceived work related factors , it is not unusual for Occupational health to be aware of circumstances of dispute between the employee & employer . It is paramount that Occupational health remain neutral & independent (irrespective of who pays their fees), there may likely be an opportunity to progress matters (Employee/employer engagement stalemate) by clearly highlighting non-medical factors that are an obstacle to return to work , recommend communication of various company policies & procedures , remind the employer of their legislative duties to address psychosocial hazards in the workplace , recommend access to Employee Assistance Programme. Timely communication of an employee’s perceived work related concerns may aid the situation without medicalization , and early signposting to other specialists such as Human Resources & Mediation would be beneficial both for the employee & employer. Employers should avoid completing managment referrals with blanket statements of ‘no modified duties ‘ , as it may not stand the scrutiny of whether ‘reasonable adjustments’ were fully explored to support the employee . The decision of ‘reasonableness’ of an adjustment eventually lies with the employer . Additionally it would be unwise to ignore any perceived workplace concerns without appropriate consideration /review. In order to ensure compliance with relevant employment related legislation , Occupational health practitioners should default to providing information regarding work adjustments and also comment on ‘fitness to engage’ in meeting .
