Should law firms have outside general counsel? Most should, even if they have an in-house GC. Sometimes a firm needs an outside voice. Could be because emotion is clouding a firm's judgment. Could be for because of internal politics. Could be just for a second opinion. Another big reason law firms should consider using outside general counsel instead of (or in addition to) in-house general counsel: The attorney-client privilege more likely to be maintained. While most jurisdictions recognize the attorney-client privilege for communications with in-house general counsel, that protection is not absolute and in practice may be inadvertently pierced or waived. With an outside general counsel, communications are more likely to remain protected. What would you add Jeff Cunningham?
