The American Relief Act of 2025 has become law. It does not address impending Med B fee schedule cuts, but does allow therapists to continue to provide telehealth services until the end of March, 2025. Congress will likely take up additional funding packages before mid-March that will (hopefully) address reimbursement cuts and provide more long-term telehealth solutions.

We all knew it was coming, but there's still collective relief at the official confirmation - DEA extended the telehealth prescribing waiver for one more calendar year, through Dec. 31, 2025. What does that mean for the states? What's DEA going to do between now and then to get prepared for right-sized and appropriate regulation of controlled substance prescribing in the context of telehealth? Who knows. But in the meantime, providers can continue to treat their patients. The text of the extension is here: https://lnkd.in/gNs-u9g8

Mental Health Practices, here is a free tip that can save you $$$$$$.
#MentalHealthPractices #MentalHealth Please update your consent forms. Providers are required to document the member's consent to receive services via telehealth. Verbal consent is acceptable, but it must be recorded in the medical record. This consent does not need to be obtained at each visit; however, there should be a document in the patient's chart indicating their consent to telehealth services. This documentation should be reviewed and updated annually.

The Ripple Effects of Uncertainty in Telehealth Policy Without a permanent federal telehealth policy, patients and providers face unnecessary challenges: - Local pharmacies struggle with DEA licensing issues for prescriptions across state lines. - Patients are left uncertain if their provider can continue treating them through digital connections. - States hesitate to create permanent rules while waiting on federal guidance, delaying critical solutions. Clinicians are dedicated to patient care, but they need clarity and stability to continue providing the best outcomes. It's time for a federal policy to ensure telehealth remains accessible and reliable for all. Jessica Rigsby, JD, CHC; Stuart Blitz; Brian Clear #ATAEDGE #Telehealth #HealthcarePolicy #PatientCare

As Judge Judy famously says, "Um is not an answer." "Um" is the part of a sentence that doesn’t need to be there. It’s a filler, a delay while someone figures out what to say or do next. But we know what to do next. We don’t need the Drug Enforcement Administration’s “um” as we wait for answers. Telehealth flexibilities aren’t just fillers—they’re critical access points to healthcare for millions. They’re necessary parts of the sentence, foundational to modern #healthcare. Let’s act now to make them permanent. For more information on how to make your voice heard, visit www.ctel.org/leftonread. #anneleftonread #telehealth #accesstocare #healthpolicy #actnow

Each state has its own laws which means we have 50 different layers of guidance when it comes to the requirements for an initial patient interaction prior to administering treatment. After the on-set of COVID, many states adopted new laws regarding the use of telehealth. Unfortunately, there is not one specific rule that applies. The only constant is that wherever a patient is at the time of exam, is where the provider/prescribe must be licensed. From there, state law takes over. It’s important to keep an eye on this before building a clinic model around it. The extension of telehealth flexibilities through December 2025 is a lifeline for millions of patients and a call to action for the healthcare industry. By allowing the continued prescription of controlled substances via telemedicine, the DEA and HHS have safeguarded access for those relying on remote care for mental health, chronic conditions, and opioid use disorder. This extension avoids immediate disruptions but underscores the need for permanent frameworks that align with the realities of modern healthcare. As we approach this new deadline, the industry has a chance to rally for sustainable, forward-thinking policies that ensure telehealth continues meeting patients where they are.
