Victoria Supreme Court rules that in proceedings which have been dismissed, court retains jurisdiction to discharge a party from an undertaking given to the court as part of the final relief granted in the proceedings: Lin v Lin [2024] VSC 759 2. Tasmania Supreme Court quashes adjudicator’s determination of payment claim as adjudicator fell into jurisdictional error by using incorrect reference date: Venture Spirits v Adjudicate Today Pty Ltd [2024] TASSC 76 3. Australian Capital Territory Supreme Court dismisses prosecution’s application to waive service requirements for expert report which was obtained only shortly before trial; holds that “oversight” is not valid explanation: DPP v Sullivan [2024] ACTSC 390 4. In Romania, the ethical duties of lawyers are rarely analyzed in literature or conferences. The same for the duties of lawyers to uphold the rule of law. That is why the material below is a good piece of paper for Romanian lawyers also.
What does it mean for barristers to uphold the rule of law? A piece Kenta Tsuda Richard Moorhead and I wrote for Counsel magazine's May 2024 edition, following our report on lawyers and the rule of law commissioned by Legal Services Board Our work offers a challenge to those in practice to take greater responsibility and ownership of the work that they do and the agency they have. Problems of mutual irresponsibility can and do arise: where the lawyer merely advises and the client decides; and where the client says the lawyer advised them they could do it. No one is then accountable for exceptionally important decisions. Asking lawyers to be reflective of their rule of law obligations does not involve second-guessing the justice of every situation, but it does involve a willingness to accept that the rule of law demands integrity in its application. https://lnkd.in/exs8fRUx
