Happy Independence Day week. This day reminds us that we must fight the law when it becomes a weapon against us. Every profession in the personal injury ecosystem has monopolistic tendencies and safeguards. There are hundreds of billions of dollars flowing through the personal injury ecosystem every year, and the more money comes in, the more people take more shares of these settlements and the costs associated with the loss payments. In legally insulated professions like these, the distribution shifts from a free market to a tax. Our forefathers may not have been personal injury or defense attorneys, but they knew this about us: a few people shielded by the law can use the laws - the same meant to protect us - against us. I don't know the real solution - maybe one day. But the next time you resolve a case - a case enabled by a US court designed by our forefathers just a handful of generations ago - ask yourself: Who is this fair to?

The 2024 year will close very soon. My advice to Attorneys, CPAs, Enrolled agents, and professionals is now is the perfect time to send closing letters to your clients. You may avoid angry calls from clients or worse cases potential lawsuits from clients. You provide a summary of the conclusion of the case and include a copy of the IRS or State Letter. If a client complains nothing was done... your response was you sent the Closing letter. Also, a client may be pleased with your service and refer clients to you! #taxattorney

(Q) Who was the real winner in yesterday's SCOTUS decision in Consumer Financial Protection Bureau v. Community Financial Services Association of America Ltd.? (A) The rule of law and the legitimacy of the courts. In an age where there appears to be growing divisions and animosity between conservatives and liberals, Democrats and Republicans, the Left and the Right, and the core institutions at the heart of the American experiment--the executive, legislative, and judicial branches--are under attack as being no longer legitimate, us lawyers have something of an obligation to defend the legitimacy of these institutions. Especially the legitimacy of the courts, which form the basis for the very legitimacy of our profession. CFPB v. CFSAA provides lawyers an opportunity to defend the integrity of SCOTUS. Notably, Justice Thomas, writing for 7 Justices, wrote the majority opinion upholding the constitutionality of the mechanism by which the CFPB is funded. Not surprisingly, he offered an originalist justification for upholding the funding. Justice Alito, joined by Justice Gorsuch, dissented. His grounds for believing the funding mechanism to be unconstitutional? Not surprisingly, an originalist review of historical practice. Far from offering proof of the illegitimacy of SCOTUS, I believe that this case reveals the validity of the courts, the importance of reasoned and disciplined debate, and the reality that the law is often not black and white. Regardless of which side of the political aisle you walk on, this decision should be celebrated.

In USA v. Trump (SDFL) Judge Cannon dismissed the Superseding Indictment and held in part that: "The Framers gave Congress a pivotal role in the appointment of principal and inferior officers. That role cannot be usurped by the Executive Branch or diffused elsewhere—whether in this case or in another case, whether in times of heightened national need or not. In the case of inferior officers, that means that Congress is empowered to decide if it wishes to vest appointment power in a Head of Department, and indeed, Congress has proven itself quite capable of doing so in many other statutory contexts. But it plainly did not do so here, despite the Special Counsel’s strained statutory readings. . . . at Pages 91-92, https://lnkd.in/emtGA3BZ In language that summons up the 2010 SCOTUS ruling in Free Enterprise Fund v. PCAOB and certainly underscores both SCOTUS's 2018 Lucia v. SEC https://lnkd.in/ekw3Y9at and SCOTUS's 2024 Jarkesy v. SEC https://lnkd.in/eeWitNxB, Judge Cannon likely sent a frisson to FINRA, which is defending against an existential challenge raised against the self-regulatory-organization in the pending Alpine Securities Corp. v. Financial Industry Regulatory Authority. It will be interesting to see how SCOTUS views the Judge's reference to the "pivotal role . . . usurped by the Executive Branch or diffused elsewhere . . ." Agree or disagree with Cannon's judicial temperament or the scholarly nature of her Order, those faced with pending FINRA regulatory actions might well opt to dig in their heels rather than settle. If FINRA is deemed unconstitutional, then its docket will likely be unenforceable. Cannon's Order reflects the tenor of the times and FINRA's existential crisis is exponentially increased. As a long-time critic of the anti-consumer nature of FINRA and its tendency to come off as a tool of Wall Street employers/management and an accessory in the social engineering out of existence of smaller firms, I shed no tears for the regulator's demise and hope to see it hastened. Going forward, we need to discuss how the vacuum of discredited self regulation is filled.

"Wins" don't always look the same. They don't always generate orders granting the requested relief. They don't always grab the headlines. But they are "wins" nonetheless. Take two recent examples of matters litigated by our firm. In one case, shortly after filing a motion seeking a venue transfer, opposing counsel consented to move the case to our requested court. In another case, shortly after we moved to dismiss the complaint, opposing counsel withdrew the matter. Neither motion gleaned a court's memorialized agreement with our position. In neither case was the opposition overtly compelled to take a particular action by the judiciary. However, the results in both matters were the same: we wanted particular relief and we got it. And, in the words of Jonah Hill's character from "Moneyball," does the means by which our client achieves the best result possible matter to us: "It does not." #litigation #motions #courts
