🚨 A major decision out of the U.S. District Court for the Eastern District of Texas: the FDA’s attempt to regulate laboratory-developed tests (LDTs) as medical devices has been struck down. The court sided with ACLA and AMP, affirming that the Rule exceeded the FDA’s statutory authority. 📄 Read the final judgment As someone who’s worked for years alongside clinical labs navigating regulatory ambiguity, reimbursement constraints, and constant pressure to innovate, this decision feels both validating and long overdue. LDTs are not medical devices. They are the result of highly specialized expertise, developed and validated by laboratorians—medical professionals—under CLIA and CMS oversight. These tests are essential to the diagnostic process, enabling providers to make timely, precise, and often life-saving decisions for their patients. This ruling restores stability, but it doesn’t solve the long-term problem: we still need intentional, sustainable legislation to protect access, incentivize innovation, and define a framework that reflects the true nature of laboratory diagnostics. I hope this ruling is the inflection point we need. Now it’s time for Congress to get it right—by engaging ACLA, AMP, CAP, NILA, CMS, CDC, and the professionals who live and breathe lab medicine every day. On March 31, 2025, U.S. District Judge Sean D. Jordan sided with Association for Molecular Pathology (AMP) and American Clinical Laboratory Association and ordered that the FDA's Laboratory Developed Tests (LDT) Final Rule be vacated and set aside, in its entirety. In its finding, the Court stated, "The final rule contemplates expanding FDA’s jurisdiction to cover laboratory-developed test services as medical “devices” under the FDCA. That expansion is foreclosed by the text, structure, and history of the FDCA and CLIA. Congress...addressed [unique lab issues] through the comprehensive but distinct statutory regime of CLIA, not through the FDCA. And Congress vested authority over those regulations in CMS, not in FDA."
