  • Re: Updated Guidance on Licensing Requirements for Mortgage Trusts and Notice of Emergency Regulations In light of the Court decision in Estate of Brown v. Ward, 261 Md. App. 385 (2024) from April of 2024, the Maryland Commissioner of Financial Regulation enacted emergency regulations to clarify licensing requirements in Maryland. The Emergency Regulations which are temporary until permanent regulations can be set into place provide for clarification as to Licensing Requirements in Maryland.

  • On April 2, 2025 and continuing, severe storms, straight-line winds, tornados and flooding affected the State of Tennessee causing widespread damage. On April 3, 2025, President Trump issued an Emergency Declaration authorizing federal disaster assistance for the state of Tennessee to supplement response efforts. All 95 Counties in Tennessee are Designated for Assistance. Recommendation Our recommendation is to immediately place a 90-day hold on foreclosures in the state of Tennessee for loans guaranteed by FHA, VA, or a Government-Sponsored Enterprise (FNMA, FHLMC, GNMA). Other loan types may also be placed on hold at the discretion of the servicer. We will monitor for additional notifications from FEMA, including major disaster declarations in the upcoming days and provide updates as soon as those are available. The U.S. Department of Housing and Urban Development (HUD) provides an automatic 90-day foreclosure moratorium beginning on the date of any Presidentially-Declared Major Disaster Area declaration.   • MTG Partner Diana Theologou has a rich background shaped by her military upbringing, having spent most of her early years in Omaha, Nebraska. She pursued her undergraduate studies in Missouri, graduating from college at the age of 20. After taking a few years off, Diana attended law school in Kansas, where she met her husband, a Maryland native. This connection brought her to Maryland in 1998, where she has resided ever since. Diana's professional journey is equally impressive. She began her legal career interning for Judge Robinson in Kansas, focusing on creditor work and representing secured lenders. With 25 years of experience in foreclosure work, Diana has a deep understanding of the field. She spent seven years running her own practice before realizing that joining a larger firm would allow her to expand her expertise. This led her to MTG, a firm that shares her approach to practicing law. At MTG, Diana manages foreclosure cases in Maryland and D.C., and handles evictions and litigation in Maryland, the Virginia, and D.C. Her commitment to her work is paralleled by her personal life, where her son serves in the military in Omaha, and her daughter follows in her legal footsteps, studying pre-law in Kansas with plans to attend law school there. Diana's life and career have come full circle, reflecting a legacy of service and dedication in both her professional and personal worlds.
