The decision represents the first substantive application of the Supreme Court’s Andy Warhol Foundation for the Visual Arts v. Goldsmith ruling and copyright fair use doctrine to artificial intelligence. Special Counsel Joseph R. was quoted in a Virginia Lawyers Weekly article about this decision, noting that it remains to be seen how the case’s determination of no fair use defense in that non-generative AI context may be applied to large language models like those at the center of other high profile generative AI copyright infringement cases. https://bit.ly/4lmdcNo
