🔷 Important announcement -- MD HB769 & SB682 On January 29, 2025, Maryland House Bill 769 (HB 769) and Maryland Senate Bill 682 (SB 682) were introduced. HB 769 and SB 682 seek to define a materially delinquent mortgage, impose requirements for sending statements prior to enforcement, and open the door for borrowers to raise a latches defense to foreclosure. A materially delinquent mortgage is defined as a “mortgage on which no payments have been made by a party, other than the secured party, in the preceding 5 years excluding any period of time in which a secured party could not institute a foreclosure proceeding due to an Executive Order or other similar official action restricting foreclosure actions.” HB 259 and SB 682 seek to impose requirements on secured parties to send at least one piece of loan-related correspondence to the mortgagor during each billing cycle for the immediately preceding 24 months. This minimum statement requirement would be limited only to the extent that the secured party is prohibited by law, regulation, or Executive Order from sending loan-related correspondence. Alternatively, the minimum statement requirement could be met by sending notice of the Materially Delinquent Mortgage at least 90 days prior to commencement of an action on a form provided by the Commissioner of Financial Regulation. Notably, failure to abide by the minimum notice requirement would allow allows mortgagors to raise the defense of latches to the enforcement of a materially delinquent mortgage. The proposed bill seeks to take effect on January 1, 2026. The firm is dedicated to providing updates on this matter and its effects on our clients.
