He regularly advises sovereigns, corporates and financial institutions on bond issuances, Islamic sukuk financings, including Sharia-compliant financial products, liability management transactions and bank regulatory capital issues. Rafe is ranked by Chambers Global and IFLR1000 for his debt capital markets work in the United Arab Emirates. Today, partner Nicole Saharsky represented Julie Edwards and Planned Parenthood South Atlantic in front of the Supreme Court of the United States. At the center of the case, 𝑀𝑒𝑑𝑖𝑛𝑎 𝑣. 𝑃𝑙𝑎𝑛𝑛𝑒𝑑 𝑃𝑎𝑟𝑒𝑛𝑡ℎ𝑜𝑜𝑑 𝑆𝑜𝑢𝑡ℎ 𝐴𝑡𝑙𝑎𝑛𝑡𝑖𝑐 𝑒𝑡 𝑎𝑙., is the question whether a patient can challenge South Carolina’s decision to remove Planned Parenthood clinics from participation in the state Medicaid program. Nicole is defending the Fourth Circuit's decision, which affirms that the Medicaid Act grants recipients the right to challenge a state's disqualification of healthcare providers, protecting their civil rights and ensuring their freedom to choose their providers. Nicole, shared with NPR: "The Congress made this determination that even when a person is insured through Medicare and Medicaid, the state isn't going to dictate which doctor they can go to.” Planned Parenthood South Atlantic currently operates two health centers in South Carolina providing various medical services to patients. #SCOTUS

Ken Wainstein has joined Mayer Brown in Washington DC as leader of our Global Investigations & White-Collar Defense practice and member of our National Security and Congressional Investigations practices. Ken has served in senior roles across both Republican and Democratic administrations, including US Attorney for the District of Columbia, Assistant Attorney General for National Security, Assistant to the President and Homeland Security Advisor, and most recently Under Secretary for Intelligence and Analysis at the Department of Homeland Security. Prior to his recent government service, Ken worked in private practice for more than 13 years. At Mayer Brown, Ken’s practice will focus on assisting clients with their most significant criminal and civil enforcement proceedings, corporate internal investigations, and congressional inquiries. His experience spans the full spectrum from complex white-collar matters to those involving export controls, sanctions, foreign direct investment, and other national security enforcement issues. Having previously led numerous high-profile independent investigations and sensitive internal reviews for corporate boards, Ken’s practice will also include internal investigations and compliance work, and the counseling and representation of clients who are facing significant legal and regulatory challenges. A case involving allegations of a paint defect in certain General Motors vehicles has been dismissed by the United States District Court for the Central District of California. In a decisive ruling, the United States District Court for the Central District of California dismissed the plaintiffs' fraud-based and express warranty claims with leave to amend, and dismissed the plaintiffs’ remaining claims for breach of implied warranty, strict products liability, unjust enrichment, and equitable and injunctive relief with prejudice. Most notably, the Court agreed that the plaintiffs had not adequately pled any of their fraud-based claims because none of the allegations, including 20 exhibits attached to the complaint, supported an inference that GM had knowledge of the alleged paint defect before the sale of the plaintiffs’ vehicles. A Mayer Brown team, including partners John Nadolenco and Andrew Demko, and associates Libby Anderson (Jelinek) (who argued the motion) and Remy Merritt, secured the dismissal of the case.
