Donnell J. Collins, a Shareholder in the Atlanta office, received a defense ruling on November 22, 2024 in a workers’ compensation case he tried in October before the Trial Division of the State Board of Workers’ Compensation as Counsel for Old Republic General Insurance and Continental Civil Heavy. Judge Nicole Tifverman issued the Award denying the former employee’s claim for workers’ compensation benefits in its’ entirety based upon a finding there was no credible evidence supporting the claim that the former employee aggravated his pre-existing neck and back condition through cumulative trauma while working for the employer. Following appeal and oral arguments, the Appellate Division issued its Award on April 3, 2025 adopting the findings of Judge Tifverman. The claimant sought both medical and indemnity benefits as a result of the injuries he allegedly sustained from operating an excavator machine. The case involved the defense of the claim that a compensable accident occurred as a consequence of an exacerbation of a pre-existing condition. Judge Tifverman determined that the former employee failed to prove an injury by accident arising out of and in the course of employment. The Court concluded there was no contemporaneous medical evidence to support the contention that the former employee was injured on the job or stopped working due to a job injury.
