About us

The ELA is a non-profit organisation with its main objective to promote and assist in the development and application of environmental law in South Africa. The organisation attracts members from an array of different environmentally-relevant disciplines which results in the ELA being an ideal forum for networking and the sharing of information and knowledge in the field of environmental law. The organization endeavors to keep up with the needs of its members and is therefore open to suggestions and recommendations on the type of assistance that the organisation could offer to its members and to others. The organisation is operated by a Secretariat (hosted at the Faculty of Law of the North-West University (Potchefstroom Campus) and an Executive Committee comprising of the representatives of different regions in South Africa and a number of ad hoc members.

    Social, environmental, climate, and inter-species justice are intertwined. My inter-, multi-, and transdisciplinary research and legal consultancy grapples with this socio-ecological reality.

    The UN Human Rights Council passed an important resolution on 28 March 2025 calling on states, among other things, to “respect, protect and fulfill human rights, including in all actions undertaken to address environmental challenges, including climate change, marine biodiversity loss, pollution and land degradation”. 👏🏽👏🏽 Check out the full resolution below.

    The City invites residents, the business community and all stakeholders to comment on the draft local spatial development framework (LSDF) for the Cape Town CBD. This framework encapsulates the City’s vision for the CBD’s future growth and will guide decisions about land use and development, density, the public realm including streets, and urban design. Once approved, it will also inform public investment in infrastructure to ensure that the CBD transitions into a more sustainable, equitable, inclusive, liveable and resilient space to the benefit of current and future generations of Capetonians.   • An important settlement has been achieved in a case brought by the Biodiversity Law Centre for BirdLife South Africa and the Southern African Foundation for the Conservation of Coastal Birds (SANCCOB) against the state to protect endangered African penguins, with novel arguments introduced by Animal Law Reform South Africa. We commend all those involved in this case aimed at the protection, promotion and fulfilment of the environmental right entrenched in South Africa’s Constitution.

    ANIMAL LAW REFORM SOUTH AFRICA ADVANCES THE RECOGNITION OF ANIMAL WELL-BEING IN AFRICAN PENGUIN CASE On 18 March 2025, the High Court handed down an order in litigation between BirdLife South Africa and others against the Minister of Forestry, Fisheries and the Environment and others. The order, which gives effect to a settlement agreement, will promote the protection of African penguins. Animal Law Reform South Africa (ALRSA) participated in the litigation as a friend of the court (amicus curiae). ALRSA was formally admitted as a friend of the court and our intervention introduced novel legal arguments, many of which have not yet been ventilated in South African litigation. These included, among others: 🐧 Considering Well-being of Animals in Decision-Making 🐧 Sentience and Intrinsic Value of Animals 🐧 Expanding of Ubuntu to More Than Humans 🐧 Interconnection between Environmental Rights and Animal Protection These arguments were not fully examined in a hearing or a judgment due to a settlement being made out of court. Nevertheless, the inclusion of submissions of this nature for the first time in South African court records is a significant milestone in the pursuit of animal law reform. By bringing these arguments formally into papers before the judiciary, ALRSA has taken a crucial step forward and provided a template for the future consideration of animal well-being in terms of NEMBA and other relevant law and policy and highlighted the importance of animal well-being in decision-making. We congratulate all parties involved on this achievement, particularly the applicants in the matter, BirdLife South Africa (BLSA) and Southern African Foundation for the Conservation of Coastal Birds (SANCCOB), as well as their attorneys, the Biodiversity Law Centre (BLC). We would like to extend our gratitude to our legal representatives, who acted pro bono, including our team of attorneys, Webber Wentzel and our counsel, Advocate Samantha Martin.     HIGH COURT VICTORY FOR AFRICAN PENGUINS! 🐧 BirdLife South Africa and Southern African Foundation for the Conservation of Coastal Birds (SANCCOB), represented by the Biodiversity Law Centre, today secured a historic victory for South Africa’s Critically Endangered African Penguin when a hard-won settlement agreement – reached by the conservation NGOs with commercial sardine and anchovy purse-seine fishers – was made an order of the Pretoria High Court. 🐧 The court order provides for the delineations of no-take zones – for the next ten years – for the commercial sardine and anchovy fishery around six key African Penguin breeding colonies that lie within coastal areas where this commercial fishery operates. Six closures work together to secure biologically meaningful foraging areas for African Penguins in each of the west coast, southern Cape and Algoa Bay regions to help bring the species back from the brink of extinction. 🐧 The imposition of scientifically-informed fishing closures, to limit commercial purse-seine anchovy and sardine fishing activities around key African Penguin breeding colonies, is a long-overdue step towards securing their survival in the wild. 🐧 We look to the Department of Forestry, Fisheries and the Environment and the Minister to ensure full implementation of this order, and to follow-through on taking all necessary steps to protect the African Penguin. Doing so is not only important for the wellbeing and survival of this iconic species but is critical to ensure that our ocean ecosystem is protected for the benefit of future generations. #lawfornature #conservation #litigation https://lnkd.in/dn_hTBCW
