  • I am so proud of our firm for winning a verdict over $1 million today against Children’s Hospital of Philadelphia in a case where CHOP never made a single settlement offer — not one penny. The case was extremely difficult. We argued that our client made telephone calls to CHOP about her son informing CHOP that her electricity had been shut off for failure to pay her bill. None of these telephone calls were documented anywhere in the medical records. Mom did not remember the name of anyone she spoke to at CHOP. Our claim was that CHOP, who didn’t own the ambulance company, should have sent an ambulance to pick up the child so he could be brought to CHOP where he could use medical machines there that the child usually used at home. The child, who died at age 11, was extremely disabled to begin with, carrying a severe genetic disorder, seizure disorder, cerebral palsy, brain injury, and sleep apnea diagnoses that had left him totally bed-bound and non-verbal since birth. The medical experts agreed the child had already lived to his life expectancy at age 11. The child died multiple days after the electricity had been restored at his home. The trial judge allowed the jury to hear evidence, through multiple witnesses, that Children & Youth Services (CYS) was making home visits to our client’s home for months before the child’s death to monitor the wellbeing of multiple children in our client’s home. There were no economic damages in the case. Most — if not all — medical malpractice lawyers would never take a case to trial with this many significant difficulties.
