Backchannel's Smart Proposal is coming at the end of 2024! Smart Proposal will help you get even more deals done through Backchannel. It acts like and follows similar rules to a traditional mediator's proposal. Smart Proposal uses a proprietary system to calculate a settlement number designed to maximize the chance of an acceptable proposal. We'll have more details and news as we get closer to launching this major update!

A couple weeks ago, we previewed an update that our users requested: Instant Matching for first offers and demands. The Instant Match update is now live!   Backchannel's core remains the same. Backchannel removes the barriers to settlement through its innovative offer and demand matching system.   With the Instant Match update, Backchannel will check for a match or overlap as soon as both parties submit their first offer or demand. (Previously, Backchannel did not check the first numbers for 48 hours.)   As before, if there isn't a match with the first numbers, the parties can secretly change their numbers as often as they wish for 28 days, with Backchannel checking for a match with each change.   This update gives you the flexibility to start Backchannel at any time and find out immediately whether there is a deal. The possibilities are exciting. For example, you could start a session while on the phone with opposing counsel to see if there's a deal right then and there. Or, break through the back-and-forth rituals of a mediation simply by opening up a Backchannel session. You might be surprised that you and the other side were on the same page the whole time.

Thanks to user feedback, we are adjusting when Backchannel checks parties’ first set of secret offers and demands. Currently, Backchannel checks the parties’ first Bids at the end of the initial 48-hour period. (Following that first phase, Backchannel checks instantly every time a party changes their Bid.) Once the change goes live in the next couple of weeks, Backchannel will check for a match as soon as both parties input an offer or demand. This change will give you the flexibility to start a Backchannel session: - during a mediation to short-circuit the tedious “back-and-forth” exchanges or help bridge the final gap in numbers; - while on the phone with opposing counsel to see if a case can resolve right then and there; - at the courthouse before a trial, argument, or other key event starts; - at the office before a deposition begins. As always, Backchannel lets you see if you have a deal without needing to reveal your real settlement position.
