In his latest Long Island Press Op-Ed, Abrams Fensterman, LLP Managing Partner, Howard Fensterman calls on political leaders—and all Americans—to remember that democracy thrives on mutual respect, even in disagreement. Refusing to acknowledge a young cancer survivor honored at the State of the Union isn’t just bad optics—it’s a moral failing. We must restore decency in how we engage with one another, before it's too late. Mr. Fensterman points to leaders like Congressman Tom Suozzi and Senator Charles Schumer as models for restoring civility and cooperation in government. "We have to find some way back to that time...." Read the full article on Long Island Press – A Call for Civility: https://lnkd.in/gp95pDXb #HowardFensterman #AbramsFensterman

Hot off the presses! 🎉Congratulations to our Partner and Director of the Matrimonial & Family Law Practice in White Plains, Jill Spielberg, on an appellate victory in Torkin v. Susac, just decided by the Second Department on March 26, 2025. Jill tried this case back in 2020 before Judge Koba and argued the appeal last summer. The result? A compelling decision packed with key issues seen time and again in complex matrimonial cases: 🔹 37% award of husband's law firm interest to the wife 🔹 Child support on $400K combined income 🔹 Enforceable award of amount of maintenance and duration thereof 🔹 Denial of separate property claim due to trust commingling A must-read for matrimonial attorneys and financial professionals alike. https://lnkd.in/ebeAS9xP
Hot off the presses!! New Second Department Appellate Division Case Decision Decided March 26, 2025 Torkin v. Susac This important case decision is packed with several interesting elements and issues that crop up in so many matrimonial matters. Some Key Takeaways are as follows: 1. Defendant wife awarded 37% of the value of plaintiff husband’s law firm interest in Sullivan & Cromwell. 2. Child Support based on combined parental income of $400,000. 3. Court utilized for purposes of determining equitable distribution a “Stop-the-Clock” date of December 31, 2016 that had been agreed upon and established by the parties when they were previously in the collaborative divorce process, rather than December 13, 2017 which was the date of commencement of the action when the plaintiff started the action. 4. Denied the plaintiff husband a separate property credit on his trust “since the plaintiff failed to sufficiently trace the source of the funds deposited into the trust and commingled marital assets with assets of the trust”. Accordingly, his trust was deemed marital property and divided equally between the parties. A fascinating read for sure. Link to case decision to read in its entirety https://lnkd.in/eiJgu4MX

Our Executive Partner, Carolyn Wolf, shares a powerful message in Newsday Media Group — expanding involuntary commitment laws is not the answer to our mental health crisis. In her Op-Ed, Carolyn explains how real reform requires long-term housing, stronger community support systems, and a better understanding of chronic mental illness — not just short-term fixes. 📰 Read the full article: “Expanding involuntary commitment won’t solve our mental health crisis.” #MentalHealthLaw #AbramsFensterman https://lnkd.in/epvPFeib
