As legislators don't make it easy, we have tried to 'simplify' the legal jargon around CSDDD. While we navigated the legal speak, we're concerned by just how much this proposal waters down the requirements, especially giving Member States much more freedom on various aspects of the regulations, moving away from the original harmonisation principle. In Australia, the latest guidance from #AANA highlights increasing expectations for responsible communications. The Australian Association of National Advertisers released the updated Environmental Claims Code on 1 March. The changes the code ushers in are welcome as they provide clarity on some areas that were previously a little muddy. They’re also a clear call for businesses and their agencies to go further than lip service when it comes to communicating about sustainability. The Omnibus speculation has kept the corporate sustainability world firmly on the edge of its seat. Now that the big day has finally arrived, it turns out that all the speculation arising from the leaks was pretty much confirmed. I’m sure you’ll all have been across the detail by now, but in a nutshell: 1️⃣ CSDDD • Due diligence limited to tier 1 suppliers • Extending intervals for monitoring due diligence measures • Reducing the definition of stakeholder and restricting engagement • Application delayed until 2028 2️⃣ CSRD • Double materiality assessments remain intact 🎉 • Reporting thresholds increased, reducing the number of undertakings subject to mandatory reporting by approx. 80% • Significant reduction in ESRS scope • Sector specific guidelines scrapped • Removing the reasonable assurance standard • Application delayed for an additional 2 years (for waves 2 and 3 - while the above is agreed) 3️⃣ EU Taxonomy • Proposed changes to Taxonomy Disclosures and Delegated Acts under Article 8 • Voluntary taxonomy reporting for large CSRD companies • Streamlined reporting templates, reducing data points by 70% post-consultation • Simplified "Do No Significant Harm" criteria for pollution control after consultation But let’s remember - this is still a proposal, and the law won’t change overnight. It’s going to take a long time for the Omnibus to be adopted, and if recent events are anything to go by, it may change again in the coming year/s. Consider this: It took 21 months for the CSRD to be adopted; 25 months for EU Taxonomy; and 26 months for CSDDD. In other words, it’s very likely we may not know the full extent of the Omnibus before 2027 ⏰ At Salterbaxter, we’ll be taking the time to digest the proposal and what this all means for business in terms of practical steps (watch this space) and in the meantime, we're doubling down on working with our clients who are already committed to taking steps towards sustainable transformation.
