Sjømat Norge sin årskonferanse gikk av stabelen mandag og tirsdag denne uken. Tema for konferansen var sjømat i en urolig verden. Stemningen blant 300 sjømatrepresentanter er spent før havbruksmeldingen presenteres av Fiskeri- og havminister i Bergen torsdag kl. 17.00. 🌊   BAHRs Fiskeri og Havbruksgruppe ved Silje Remøy og Mari Sørensen Aksnes var tilstede på konferansen. Silje deltok i panelsamtale om sjømatnæringens omdømme. Under panelsamtalen poengterte Silje Remøy blant annet at «Advokater bør bruke sin ekspertise og sine verktøy til å fremme en konstruktiv dialog mellom næringslivet og myndighetene». Når den globale handelspolitikken er preget av ustabilitet, blir det enda viktigere å ha en stabil og forutsigbar norsk næringspolitikk. Tilliten mellom myndighetene og havbruksnæringen er fortsatt skjør etter den uventede innføringen av grunnrenteskatt i 2022.

We believe that a key factor behind this is the courts’ proactive efforts to remain a relevant and attractive alternative to arbitration. This edition features a conversation with District Court Judge Anette Barth and Supreme Court Justice Christian Lund, who share their perspectives on these issues and offer insights into how Norwegian courts address large commercial disputes. 🧑⚖️   The publication also includes an article on “Privilege in Arbitration,” inspired by the discussion at our pre-conference event preceding this year’s Norwegian Arbitration Day. Regjeringen la 4. april frem forslag nummer tre i rekken med formål om å sikre det som omtales som «norske lønnsvilkår» på skip i norske farvann og på norsk sokkel. Lovforslaget innebærer at skip i norsk innenriksfart og skip som yter tjenester tilknyttet næringsvirksomhet til havs, blir gjenstand for et krav om norske lønnsvilkår. Et tilnærmet likt forslag ble sendt på høring i mai 2024, og møtte mostand fra EFTAs overvåkningsorgan (ESA). At the International Financial Law Review's (IFLR) annual European awards ceremony this week, BAHR secured a quadruple win, being recognised with four prestigious awards:   🟧 Team of the Year for M&A: Regional 🟧 National Firm of the Year for Norway 🟧 Deal of the Year for Private Equity 🟧 Net Zero Transition Award   We are particularly pleased that our extensive work in the mergers and acquisitions field across the region has been recognised with the "Team of the Year for M&A: Regional" award. This accolade underscores BAHR's standing as a leading European law firm in M&A, enhancing our prominence beyond Norway and the Nordics. At the award ceremony, special attention was given to BAHR's role in major transactions, such as Adevinta and Vår Energi/Neptune. These projects, among others, collectively demonstrate BAHR's expertise and ability to deliver legal services in complex M&A transactions across Europe.   For the third consecutive year, BAHR also earned the title "National Firm of the Year: Norway," awarded by IFLR's editorial team. This honour underscores legal innovation in cross-border transactions that reached financial close during the 2024 calendar year.   The landmark transaction between Blackstone/Permira and Adevinta showcased BAHR's pivotal role, resulting in the "Deal of the Year: Private Equity" award, shared with all legal teams involved.   Finally, BAHR received the "Net Zero Transition Award" for the second consecutive year. This accolade celebrates significant progress towards net-zero transition through initiatives that enhance sustainability, support client decarbonisation, or foster innovative deals that advance market practices. The Danish Financial Supervisory Authority (FSA) has conducted an inspection of asset managers claiming to offer sustainable investments under the Sustainable Finance Disclosure Regulation (SFDR). It recently published its findings related to three fund managers, revealing significant compliance gaps and resulting in enforcement actions. The findings also include the Danish FSA’s expectations regarding the “good governance” requirement in SFDR, which are relevant for all managers of products subject to SFDR Article 8 and Article 9, and non-compliance with international standards such as the UN Global Compact. Norwegian asset managers, including managers of alternative investment funds, can gain valuable insights from these cases to strengthen their own compliance frameworks.
