In China, anyone can file a request for the declaration of invalidation of patent on the grounds of non-compliance with the relevant provisions of the Patent Law. The principle of good faith, as a general clause that plays a catch-all role, will become increasingly prominent in the patent granting and right confirmation procedures as the process of building a law-governed and integrity-based society progresses. In the newest edition of China Patent Review newsletter, Ryan Xu talks about the application of the principle of good faith in China's patent invalidation proceeding by analyzing the latest development of patent regulation. #IntellectualProperty #patent #law #protection #innovation #chemistry #invalidation

【"0" means "Zero"?】Recently, the "千禾0“(Qianhe 0 in Chinese)trademarks has sparked widespread debate due to its association with the concept of "zero additives". With many consumers feeling that they have been deceived, this topic has brought a large amount of discussion with over 1800 million views on Chinese social media, and a significant coverage on mainstream media. From the perspective of current Trademark Law, the trademark itself does not violate prohibitive regulations. However, the intergration of the trademark with "zero additive" has led to misconceptions about product characteristics, highlighting regulatory gaps in governing "zero additive" claims. As a trademark legal practitioner with nearly 20 years of extensive experience in IP world, our counsel Eva Hu's article explores how to better regulate the reasonable use of trademarks and labeling to prevent consumer deception, from the angles of trademark law, food safety law and market supervision.
